I hope it doesn't take away his ability to think and speak. Suspect is charged with 2nd degree murder. I don't get how it's 2nd degree when this is obviously planned with intent.
shareI don't know how it works in the US, but here in the UK they sometimes drop to a (slightly) lesser charge if they think it'll be easier to prove.

It's attempted second degree murder due to a quirk of NY state law, namely that first degree murder applies to the murder of police officers (and to certain other special circumstances which haven't yet been shown to apply here). Other murder or conspiracy/attempt thereof is necessarily something other than first degree.
Separately, 2nd degree murder doesn't mean that there is a lack of premeditation. In many cases, events that would constitute 1st degree murder in other states are 2nd degree murder in NY state.
You are right though that sometimes they charge lower for a likely conviction but this is NY we're talking about. He may even get a light sentence.
