Should a seasoned criminal like Frank Nitti really have any reason to panic and initiate a shoot out?
Even when Ness realizes that Nitti had Malone's address written down in a matchbook, it doesn't really prove anything (other than a "smoking gun") in court, now does it? Then again, Nitti did have close ties with Al Capone and having the home address of a gunned down Chicago cop like Jim Malone (who just so happened to be shot in his house), would've been enough to trigger an investigation.
