Jerry Graff and the leads


I was just wondering, how could Jerry Graff use the leads if they were stolen? As soon as Premiere Properties/Mitch & Murray reported that their leads were stolen, wouldn't they eventually find out that Graff's company is calling their clients?

There's no proof that's they got the leads from a stolen source. Or they could claim they were bought in good faith.

It's also possible Jerry Graff could claim he generated those leads on his own, or from some other third party. Particularly if they are mixed in with other existing leads he has.

Moss touches on this, saying something to the effect that the leads are negotiable, essentially immaterial, and as such are hard to track down.

Think of stealing $20 from someone's wallet. If there are no, witnesses, physical evidence, or confirmed serial numbers, it's not enough to establish guilt by saying 'I had $20 in my wallet and it's gone, and now you have $20 in yours, so it MUST have been mine'.

The leads don't constitute 'clients' per se. The leads are people who have made enquiries about buying, expressions of interest. It's not unreasonable at all to assume if someone made a serious enquiry with Mitch & Murray, they may also have made an enquiry with Jerry Graff's firm.

I don't know how real estate leads work, so it's very possible I'm completely wrong on this.

I'd guess the leads are not the property of any one company. Certainly other companies would have the same leads thus it would be hard to say where they came from unless Moss and Levene flipped to the po-po and said Graff knew they were stolen...but they'd have to prove it. I guess Levene offering the bribe to Williamson would be proof but only circumstantial. Graff could just deny they came from them.

On the other hand, if the leads were marked with some kind of letterhead or watermark it would prove they came from Moss and Levene. But they'd still have to prove Graff knew they were stolen.
