Probably because Miklo actually shot and killed a guy.

he was already on parole at that time, so once he broke parole, he was off to jail

Besides the shooting part, he wasn't an ex-gold glove champ ....and his dad wasn't an ex-Marine who could pull strings for him....like Paco.
