This question has been brought up - I think people assumed if they've been living together long enough it would be considered common law marriage.

But since the whole thing was based on false pretenses, I don't know why even the common law marriage would not be overturned.

Isn't the legal age for marriage in that state 16?

Under 18 still needs parental consent because you can't enter into contracts until you're 18.Obviously it would be ridiculous if the judge threw out the prenup because a contract signed by a minor is unenforceable but enforce her marriage license.

Maybe she did have parental consent for the marriage contract, but pre-nuptial agreement isn't valid even with parental consent?

That's what I always thought too. California doesn't have common law marriage anyway, so I'd assume (hopefully) that got sorted out at Samantha's next custody hearing. She was hot and had such a sexy voice, but she wasn't a very good human being. When she literally ripped the kids away from their dad is the point it definitely changed in Fletcher's mind, since he could obviously understand what he was going through at the time.
