Would Scott still be a wanted fugitive from the kidnapping charges and breaking out of jail in the first movie? Even if Neal and Laura dropped any civil suit against Scott related to kidnapping Charlie, the police would still have grounds to arrest Scott for his criminal activities from a legal standpoint.

Good point.

But we can assume by the second film (and many years), whatever trouble he got into was resolved.

We can also wonder if the police may have been reluctant to tell the truth - which is a bunch of kids using tinsel as a tool extracted Santa Claus from the pokey...
