for stealing the cigarettes? was it because they think he is retarded?

How could he not get caught? He was sitting in the back seat of the car surrounded by the cigarettes when the other two got arrested. Im sorry, but I'm not buying that answer.

He ran out of the car when Ricky stopped to take a piss, and hid under an underpass.
