Because they sure didn't waste anytime firing Mitchel Musso after his arrest for the same thing while starring on 'Pair of Kings'! Two months later not only was he replaced on the show, they basically rewrote the premise of the show by making the twins triplets and his character was literally erased from the plot.

But a couple factors to think of:
…But I also think, IIRC, Season 3 is complete and will be running for a while, maybe they'll (Disney) will see how things go. It will probably be forgotten by season's end and outside of gossip blogs and sites I haven't seen any "notable" entertainment or news give it a mention…
They also already announced/committed to next season (Season 4), so I would think if they would fire him, they would announce it pretty soon…also taking into consideration it usually seems like filming starts in the summer (minus Season 1).
We'll just have to wait and see, it could go either way I think.
By now the House of Mouse should be concerned with the continued pressure their stars are under to be perfect. The minute most of Disney's stable turns legal adult they act just like any kid whose been raised in a really strict home. Shia Labeouf is admitting addiction to alcohol. They're working in an adult world making big salaries and some of them are probably calling the shots at home once they realize mom & dad need them more than the other way around. Not to mention the studio also wants them to take roles keeping within Disney's child friendly entertainment. Which could end a career after Disney before it even starts.
I've also posted on the board of Disney shows that these kids aren't stupid. Reality tv has shown us that a career can be made for some with bad/ugly behavior/choices and could lead to film roles and stardom. Many can't stand being known as an ex-Disney star and gladly go down the wrong path even before they're free.

What really helped Billy...and I think doomed Mitchell Musso...was the coverage of the cases. Nobody outside of a few blogs covered Billy's and Mitchell's was covered everywhere. That worked in Billy's favor IMO.
Glad he's back though...I'd stop watching if anyone left.
