So there are only a couple ways this statement makes sense.
The dead sister had a female partner so the daughter has 2 moms.
The dead sister adopted the daughter and now the biological mother wants custody.
Any other possibilities?

No. You may have misread that. He battles with the child's grandmother. It's a good movie, 7.8/10. Go see it. And Chris Evans is really good in it, along with Octavia Spencer (who seems to be in every movie these days), and Mckenna Grace, who plays the little girl, is VERY good.
